Terms of Service

These Terms of Service ("Terms") govern your access to and use of The Scheduling Expert (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

The Scheduling Expert provides online appointment-scheduling software, including public booking pages, a staff and admin dashboard, calendar synchronization, automated reminders, and payment collection through third-party processors.

2. Accounts & eligibility

  • You must provide accurate information and keep it up to date.
  • You are responsible for safeguarding your login credentials and for all activity under your account.
  • You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.

3. Subscriptions, billing & trials

  • Paid plans are billed on a recurring basis (monthly or annually) through our payment processor, Stripe.
  • Free trials, where offered, convert to a paid subscription only if you choose to subscribe; we describe the trial terms at sign-up.
  • Unless required by law, fees are non-refundable. You can cancel at any time; cancellation stops future renewals, and access continues through the end of the current billing period.
  • We may change prices with reasonable prior notice; changes apply to the next billing cycle.

4. Payments to you and your clients

If you use the Service to collect payments from your clients, those payments are processed by Stripe under Stripe's own terms, and are settled to your connected Stripe account. We are not a party to the transaction between you and your clients, and we are not responsible for disputes, refunds, chargebacks, or taxes arising from them.

5. Your content and your clients' data

You retain ownership of the information you and your clients submit ("Your Content"). You grant us a limited license to host and process Your Content solely to provide the Service. If you use the Service to collect information about your own clients, you are responsible for having any necessary rights and consents, and for complying with applicable privacy laws. Our handling of personal information is described in our Privacy Policy.

6. Acceptable use

You agree not to:

  • use the Service for any unlawful, fraudulent, or harmful purpose;
  • send spam or unsolicited messages, or violate anti-spam laws;
  • interfere with or disrupt the integrity or performance of the Service;
  • attempt to gain unauthorized access to the Service or other users' data; or
  • reverse engineer or resell the Service except as expressly permitted.

7. Third-party services

The Service integrates with third parties such as Google, Stripe, and email providers. Your use of those integrations is subject to their terms and policies, and we are not responsible for their acts or omissions.

8. Intellectual property

The Service, including its software, design, and content (excluding Your Content), is owned by The Scheduling Expert and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, The Scheduling Expert will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless The Scheduling Expert from claims and expenses arising out of your use of the Service, Your Content, or your violation of these Terms or of any law or third-party right.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends; sections that by their nature should survive will survive.

13. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Georgia, unless applicable law requires otherwise.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will revise the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
